In recent developments, NVIDIA has reportedly come under scrutiny by the U.S. Department of Justice (DOJ) due to alleged antitrust practices concerning the sale and leasing of its AI GPUs and data-center networking equipment. This investigation, as reported by “The Information,” has led to a notable drop of 3.6% in NVIDIA’s stock during pre-market trading on Friday (08/02).
Details of the Allegations
The primary complaints appear to stem from a special interest group within the customer base for AI GPUs, rather than from competitors in the AI GPU market. U.S. Senator Elizabeth Warren and other progressives have been particularly vocal, urging the DOJ to look into the matter. Officials have also been engaging with NVIDIA’s competitors such as AMD and Intel to gather more information.
The crux of the complaint suggests NVIDIA has allegedly pressured cloud customers into purchasing “multiple products.” While the specifics remain unclear, theories range from NVIDIA requiring commitments to multiple generations of products to bundling various offerings, including server systems and first-party software, beyond the necessary hardware.
Market Dynamics and Customer Impact
NVIDIA currently holds a dominant share of 80% in the AI GPU market, leaving AMD and Intel to capture spillover demand. One aspect of the antitrust complaint is the allegation that NVIDIA charges a premium for data-center infrastructure products when customers also buy AI GPUs from AMD or Intel.
AMD’s Instinct CDNA and Intel’s Gaudi accelerators have garnered interest from cloud customers, particularly in light of pricing and delivery timelines concerns related to NVIDIA’s products.
